0. DEFINITIONS
Seller means Garden House Design, the trading name of Touch of Magic Limited, 4 Roundstone Barn, Roundstone Farm, Littlehampton Road, Worthing, West Sussex, BN12 6PW and the company's web site www.touchofmagicdirect.co.uk. Customer means the person or company to whom this document is addressed. Supplier means Touch of Magic Limited.

1. GENERAL
1.1 These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as Touch of Magic, to the buyer hereafter referred as the Customer.
1.2 All information including pricing is correct at the time of publishing.
1.3 All items are subject to availability.
1.4 The reproduction of products is accurate as photographic and printing process permit and Touch of Magic cannot accept responsibility for variances in colour and style. Every effort will be made to ensure that the reproduction is of the highest quality.

1.5 Touch of Magic reserve the right to refuse orders.

2. PRICE
2.1 All prices are quoted in Pounds sterling and are inclusive of VAT at the current rate, unless otherwise specified.
2.2 All prices are inclusive of postage and packing for delivery to mainland UK, unless otherwise stated.

3. PAYMENT
3.1 Payments must be made in Pounds sterling only, unless otherwise specified, and by one of the following payment methods
- Major credit cards as listed: Mastercard, Visa, Switch, Solo, Visa Delta.
- Cheques made payable to Touch of Magic Limited.
- Bank transfer

4. PASSING OF RISK - The risk in the goods shall pass to the Customer on delivery, as defined in clause 5.3 below.

5. DELIVERY
5.1 DELIVERY DATE:

Any date or period for delivery shall be considered as indicative only, although it is our policy to try to fulfil all orders within 28 days. We will pass on customer details to supplier for delivery. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the supplier. Touch of Magic Limited, cannot be held responsible for delays in the delivery caused by the supplier, or any other third party. If delivery is not within the agreed time we will, with their agreement, arrange another time for delivery. If we cannot agree another time for delivery, we offer the consumer a refund.

We cannot accept overseas orders placed through our website. Please call 01903 774774 or email sales@gardenhousedesign.co.uk for details on overseas orders.

5.2 SHIPPING:
All products are sent from our suppliers. Unless otherwise specified, all products must be signed for. The Customer must request any other delivery method at the time of the order, and goods will be shipped under Customer's responsibility as defined in clause 5.3.
5.3 PASSING OF RISK:
When goods are delivered through our suppliers, the Customer bears the risk, once the goods have been signed for. For other delivery methods, the Customer bears the risk once the goods have left our suppliers' premises.

6. ACCEPTANCE
The Customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within a reasonable time after their receipt the Customer shall have notified the seller that the goods are rejected. (This does not however affect the customers statutory rights). If no such action has been taken, Touch of Magic Limited shall consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any reject at a later date. The Customer has up to seven working days to cancel the order without giving a reason. With the seven working days starting the day the customer receives the goods.

7. RETURN PROCEDURE
7.1 If the goods are to be rejected in the time limit set in clause 6 above, the Customer shall comply with the return procedure as defined in clause 7.2, below. Touch of Magic Limited will not accept any returned goods should the return not follow the aforementioned return procedure.
7.2 The Customer must contact Touch of Magic Limited Customer Services on 01903 774774, and obtain a Returns Authorisation Number (RAN). This number shall be clearly quoted on the returned package. Touch of Magic Limited will arrange for the package to be collected. A collection fee may apply to returns where goods are not damaged or faulty.
7.3 In cases where the goods are rejected within a reasonable time, the Customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to the supplier before the refund or replacement can be issued. Refund is within 30 days of cancellation.

8. CANCELLATIONS
8.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been dispatched. If the order has been dispatched prior to the cancellation, the return procedure as defined in clause 7 (7.2 and 7.3) above will apply. If the procedure is not respected, the order will be considered valid and the Customer will remain liable for the full payment.
8.2 Cancellations can be made with Touch of Magic Limited support line on 01903 774774. Customers will be provided with a Cancellation Reference number (CRN) for them to keep for future reference or email sales@touchofmagicdirect.co.uk.

9. LAW
These terms and conditions are governed and shall be interpreted in accordance with UK Law.
